INTRODUCTION

Media Arena LTD ("Company", "we" or "us") adheres to the practices detailed in this Privacy Policy ("Privacy Policy") in respect of your use of our Installation Platform or Software or browser extension. We respect our users' privacy and we have designed this Privacy Policy so that you can clearly understand our privacy and data collection practices, as required, among others, according to the EU General Data Protection Regulation ("GDPR") and the California Consumer Privacy Act ("CCPA"). We recommend you to read this Privacy Policy carefully prior using our Installation Platform and Software or browser extension. This Privacy Policy is part of our Terms of Services therefore, definitions herein shall have the same meaning as defined in the Terms.

1. CHANGES TO THE PRIVACY POLICY

We reserve the right, at our discretion, to revise or update these Privacy Policy at any time. Such changes shall be effective upon publication of the amended Terms. The last revision will be reflected in the "Last Modified" heading. In the event of material changes that will adversely affect your use of the Installation Platform or Software or browser extension or the data collection by us, we will make best efforts to provide you with notification through the Installation Platform or Software or browser extension.

1. TYPES OF INFORMATION COLLECTED AND LAWFUL BASIS

During your use of the Installation Platform and Software or browser extension, we will gather and processes the below data. The data that will be processed will include non-identifiable aggregated information ("Non-Personal Data") transmitted from you device, as well as data that identifies a user or may identify a user ("Personal Data").

The types of data that we collect as well as the purpose for processing such data and our lawful basis for processing the data are specified in the table below.

Technical Data and Online Identifiers: If you use our Installation Platform or Software or browser extension, we will collect your IP address and/or MAC address (Machine ID). In addition, we will collect technical data transmitted from your device, such as: • The type of device and operating system; • Date and time stamp; • Language preferences; • Browser used and traffic source which lead to the Installation Platform; • Apps installed on device. Online identifiers are processed under our legitimate interest as it is necessary for operating and providing the services. We use online identifiers and the technical data in order to audit and track installations, verify that any installed Software or browser extension are compatible with your computer; by determining which Software or browser extension or Third Party Software or browser extension and of what version should be offered to you and installed on your computer; by correlating errors with certain technical information for debugging purposes; and by creating and managing statistics to guide future improvements and developments to further improve, refine, customize and develop the Installation Platform and Software or browser extension, as well as to perform research, and conduct associated analytical and statistical activities, detect fraud, security or technical issues in connection with the Installation Platform and Software or browser extension and calculate payments.
Contact Details: If you contact us for support and voluntarily provide us with your contact information, including your name and email address. We will process your contact details and contact history with us only in order to respond to you, provide you with support, assist you or provide you with any other service that you may request. We will retain our contact history and correspondence, in the event we find it applicable (e.g., in the event of future claim, to provide you with support, or to improve our services).
USE SHARING DATA WITH THIRD PARTIES

We will share Personal Data collected solely in the following events:

  1. We may share your Personal Data in order to comply with any applicable law, legal process or governmental request as well as for the purpose of enforcing our agreements and policies, establish, exercise or defend our rights and third party's rights, and any applicable needed action in this regard. In addition, we may share your information to prevent or detect illegal activities, wrongdoing, and suspected fraud.

  2. We may disclose Personal Data to our service providers so that they can perform requested services on our behalf. We prohibit such service providers from using your Personal Data for any purposes.

  3. We may share your Personal Data to third parties when you provide your consent to a particular disclosure. However, if we do share your information based on your consent, following such disclosure, the information shared will be subject to such third party's privacy practices which might differ from our practices detailed herein.

  4. We may share your Personal Data with a parent company, subsidiaries, joint ventures, or other companies under common control ("Affiliated Companies") solely if and when applicable or necessary. In addition, we may share information, in the event of a corporate transaction (e.g. sale, merger, consolidation, etc.), provided however, that our Affiliated Companies or acquiring company will be subject to the obligations detailed herein with respect to your Personal Data;

  5. We may share online identifiers with our business partners (as detailed above), for the purpose of fraud detection and calculating payments.

  6. We may disclose your Personal Data to a third party for a business purpose (under the CCPA). When we disclose Personal Data for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

NO OBLIGATION TO STORE INFORMATION

Nothing in this Privacy Policy is interpreted as an obligation to store information, and we may, at our own discretion, delete or avoid from recording and storing any and all information.

TRANSFER OF DATA

We may store or process your information in the United States or in other countries. If you are a resident of the European Economic Area ("EEA") we will take appropriate measures to ensure that your information receives an adequate level of data protection upon its transfer outside of the EEA. If you are a resident of a jurisdiction where transfer of your data requires your consent, then your consent to this Privacy Policy includes your express consent for such transfer of your Personal Information.

SECURITY

We use high security techniques to prevent your information from being accessed, used or disclosed without authorization, unlawfully destructed or accidental loss. However, although we make best efforts we can't provide 100% security and we cannot be held responsible for unauthorized or unintended access that is beyond our control. YOUR RIGHTS & DATA RETENTION

Data protection and privacy laws relevant to your jurisdiction may provide you with certain rights related to the data we collect from your use of the Installation Platform and Software or browser extension, and depending on our lawful basis for collection and retention of data. This rights may include one or all of the following: (i) you may request to access your Personal Data that we hold; (ii) you may request the rectification of your Personal Data that we hold; (iii) you may request the erasure of your Personal Data that we hold (as long as we do not have a legitimate reason for retaining the data); (iv) you may request to restrict processing of your Personal Data; (v) you may object to processing of your Personal Data by us; (vi) you may request to exercise your right of data portability; (vii) you may exercise your right to file a complaint to a supervisory authority in your jurisdiction; and (viii) you have the right to withdraw consent (to the extent applicable).

Please note that -

  1. We may request additional information from you when you contact us in order to verify your identity and locate your data.

  2. It may take time to process requests in a way that is consistent with applicable privacy law.

CHILDRENS' DATA

Regardless of the aforementioned, we do not knowingly collect or store Personal Data regarding children , as defined under applicable law, and specifically, under the age of 16. In the event that we become aware that a user is considered as a child under applicable law has shared any information, we will discard such information. If you have any reason to believe that a child has shared any information with us, please contact us. If you are under 18, please be sure to read this Privacy Policy with your parents or legal guardians and ask questions about things you do not understand.
